Mark W. Gerganoff

Senior Attorney

  • Mark Gerganoff joined Montgomery | Amatuzio as a Senior Attorney in 2026. Prior to joining the firm, he maintained a diverse practice representing insureds and insurers in defense-related matters in both state and federal courts, including the handling of subrogation claims for national carriers. He has authored countless coverage opinions, conducted many examinations under oath, and resolved a wide range of claims through negotiated settlements.

    Mark’s practice emphasizes insurance defense, general civil litigation, contract and property tax disputes, and appellate and judicial review proceedings. He also handles bodily injury matters, including premises liability and wrongful death cases, as well as construction defect disputes. Over the course of his career, Mark has handled more than sixty appeals, argued fifteen cases before the Colorado Supreme Court, and successfully prosecuted eleven petitions for certiorari review. He has also appeared numerous times before the Tenth Circuit Court of Appeals.

    Since 1983, Mark has also represented governmental and private interests in labor and employment disputes and regulatory matters, including professional license disciplinary proceedings. His work has included countless appearances before administrative agencies and participation in several multi-million-dollar state-court class actions. He has handled dozens of arbitrations and successfully mediated a wide variety of disputes, saving clients substantial time and expense.

    Outside the practice of law, Mark is a passionate musician. He performs approximately once a week in the Denver metro area or at Summit County ski resorts and has opened for Dave Mason, Leon Russell, David Wilcox, Savoy Brown, Foghat, and Tab Benoit. He frequently performs at the Little Bear Saloon, his favorite venue outside federal court. Mark is also a committed exercise enthusiast. He has maintained a daily exercise routine since June 1981, rotating among swimming, biking, running, squash, skiing, and elliptical training. In 2007, he and a high school friend completed an eight-mile open-water swim from Windmill Point in Grosse Pointe Shores, Michigan, at the mouth of the Detroit River, to the Ambassador Bridge in downtown Detroit. While short of his original goal of swimming the full length of the Detroit River, he notes that if he makes a second attempt, he promises to train first.
